The rise of sports law allowed to regulate longlasting unappropriate behaviours, especially the quasi-monopolistic situation of the athletes contracts hold by sports agents. The law of March 28th 2011 authorizes the lawyer to become a sports agent on behalf of an athlete in France.

In principle, the article L222-7 of the sports code in France reserves exclusivity for the missions linked to sports contracts for sports agents licence holders. However, the law n°2011-331 of March 28th 2011 changes rules in favor of the lawyer. In its article 4, it allows the lawyer specialized in sports law to become a full-scale sports agent and then to be able to practice an activity nearly similar to the one of a sports agent. It gives priority to the lawyer in the clubs/athletes relations, especially thanks to the ethical approach concerning the lawyer's actions. It then regulates some behaviours that we can observe in the sports agents world where several deviations often remain (personal interests to the detriment of the client, illegal practice of the profession (without any licence), etc).

This law then allows to get access to the sports agents world for authorised legal practitioners. It should be noted however that, similarly, the french modernization law n°2011-331 has the action of limiting the authorised sports legal practitioner's possibilities by a strict regulation that limits the flexibility for members of the legal profession. The deontology applied by the authorised sports legal practitioner constitutes the main asset in its possession in relation to the sports agent. It also constitutes its main weakness since it exposes the lawyer specialized in sports law to comply with a strict regulation that does not concern the sports agent.
